1. Objet et Champ d'Application

Les présentes conditions régissent toutes les ventes de repas et boissons effectuées sur le site officiel de Zafran Paris. En validant sa commande, le client accepte sans réserve les modalités ci-dessous.

Processus : Le client sélectionne ses plats (Entrées, Curry, Biryani, Naans, etc.), valide son panier, renseigne ses coordonnées et procède au paiement.
Confirmation : La vente n'est considérée comme définitive qu'après réception de l'e-mail de confirmation de commande envoyé par Zafran Paris.
Disponibilité : Les produits sont proposés tant qu'ils sont visibles sur la carte en ligne. En cas de rupture (ex: épuisement d'un plat du jour), le restaurant contactera le client pour proposer une substitution ou un remboursement.

3. Modalités de Retrait et Livraison

Le restaurant Zafran propose deux modes de service pour vos commandes en ligne :

Click & Collect (Vente à emporter) :
- Lieu : Le retrait s'effectue directement au restaurant au 35 rue Saint-Pétersbourg, 75008 Paris.
- Horaires : Un créneau horaire est sélectionné lors de la commande. Le restaurant s'engage à préparer les plats pour l'heure dite afin de garantir la fraîcheur et la température des produits.
- Frais : Ce service est totalement gratuit et sans minimum de commande.
Livraison à domicile :
- Zone desservie : Nous livrons dans un rayon de 3 km autour du restaurant (incluant principalement les 8e, 9e, 17e et une partie des 10e et 18e arrondissements). L'éligibilité de l'adresse est automatiquement vérifiée lors de la saisie des coordonnées.
- Minimum de commande : Le service de livraison est disponible pour toute commande d'un montant minimum de 45,00 € TTC.
- Frais de livraison : Une participation forfaitaire de 6,00 € est appliquée à chaque commande en livraison.
- Délais : Le délai moyen est de 30 à 45 minutes. Ce délai est indicatif et peut varier en fonction du nombre de commandes et des conditions de circulation à Paris.

4. Prix et Modalités de Paiement

Tarifs : Les prix affichés sur le site sont indiqués en euros TTC. Conformément à la législation, le taux de TVA appliqué est de 10% pour les produits alimentaires et de 20% pour les boissons alcoolisées.
Paiement sécurisé en ligne : Le règlement immédiat des commandes s'effectue par Carte Bancaire (Visa, Mastercard, American Express) via la plateforme sécurisée Stripe, ou par Apple Pay / Google Pay.
Paiement sur place (Click & Collect uniquement) : Pour toute commande en retrait au restaurant (35 rue Saint-Pétersbourg), le client a la possibilité de choisir l'option "Paiement sur place". Le règlement s'effectue alors au moment du retrait de la commande, par tout moyen de paiement accepté au comptoir (Espèces, Carte Bancaire, Titres-Restaurant).
Titres-Restaurant : Pour des raisons techniques, les cartes et titres-restaurant (Bimpli, Edenred, Swile, Up, etc.) ne sont pas acceptés pour le paiement directement en ligne. Ils sont uniquement acceptés pour les commandes payées sur place au restaurant dans le cadre du Click & Collect, dans la limite du plafond légal journalier en vigueur.

5. Droit de Rétractation et Annulation

Produits périssables : Conformément à l'article L221-28 du Code de la consommation, le droit de rétractation de 14 jours ne s'applique pas aux commandes de repas préparés, car ils sont susceptibles de se détériorer rapidement.
Annulation : Toute commande validée ne peut être annulée si le restaurant a déjà commencé la préparation des plats.

6. Hygiène et Allergènes

Allergènes : La cuisine indienne utilise fréquemment des fruits à coque (noix de cajou, amandes), du lactose (ghee, crème) et du gluten (naans).
Responsabilité : Le client est tenu de consulter la liste des allergènes ou de mentionner toute allergie dans la section "Commentaires" de sa commande. En cas d'allergie sévère, il est impératif d'appeler le restaurant avant de commander.

7. Vente d'Alcool

Minorité : Conformément à l'article L3342-1 du Code de la santé publique, la vente d'alcool est interdite aux mineurs.
(L'abus d'alcool est dangereux pour la santé)

8. Annulation et Remboursement

Erreur ou Non-conformité : En cas d'erreur de commande (plat manquant ou erreur de produit) constatée à la réception :
- Click & Collect : Le client doit le signaler immédiatement au comptoir pour échange ou remboursement.
- Livraison : Le client doit contacter le restaurant par téléphone au +33 1 45 22 29 73 dans les 15 minutes suivant la livraison. Un avoir ou un remboursement partiel pourra être effectué via le mode de paiement initial (Stripe).
Délais de remboursement : Les remboursements acceptés sont effectués directement sur la carte bancaire ayant servi à l'achat sous 5 à 10 jours ouvrés (délai lié au système Stripe).
